Instructions on Withdrawal
Right of Withdrawal
You have the right to withdraw from this contract within 60 days without giving any reason. The withdrawal period will expire after 60 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform us (BeyondBright c/o Betahaus, Eifflerstr. 43, 22769 Hamburg, Email: support@trackcard.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached Model Withdrawal Form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement.
We may, however, withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
Return of the Goods
1. Return costs:
• You will in any case bear the direct cost of returning the goods. Returns sent without sufficient postage will not be accepted.
2. Packaging:
• Please return the goods – if possible – in their original packaging and in secure outer packaging to avoid damage in transit. However, this is not a prerequisite for the effective exercise of the right of withdrawal.
3. Compensation for diminished value:
• You are only liable for any diminished value of the goods resulting from handling of the goods that was not necessary to establish the nature, characteristics and functioning of the goods.
• If, for example, the goods are returned with clear signs of use (scratches, dents, discoloration, or similar) that go beyond what is necessary for normal inspection, we reserve the right to withhold compensation for diminished value or not to refund the full amount.
Exclusions or Expiry of the Right of Withdrawal
The right of withdrawal does not apply, or expires, in the case of contracts for
• the supply of goods that are not prefabricated and that are made on the basis of an individual choice or decision by the consumer, or that are clearly tailored to the consumer's personal needs;
• sealed goods that are not suitable for return for reasons of hygiene or health protection and whose seal has been removed after delivery;
• other statutory exceptions pursuant to Sec. 312g(2) of the German Civil Code (BGB).
